1. Overview

Welcome to Job Quality One ("Service"), a manufacturing quality management system operated by Backwards Thinking LLC ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Account Terms

By creating an account with us, you agree that:

  • You must be 18 years or older to use this Service
  • You must provide your legal full name, valid email address, and any other requested information
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the security of your account and password
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Payment Terms

4.1 Subscription Fees

  • The Service is billed in advance on a monthly or annual basis
  • All fees are exclusive of applicable taxes
  • Fees are non-refundable except as required by law

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You will be charged through your selected payment method.

4.3 Price Changes

We reserve the right to modify our prices. Price changes will be communicated at least 30 days in advance. Your continued use of the Service after the price change constitutes agreement to the new pricing.

4.4 Failed Payments

If payment fails, we may suspend your access to the Service until payment is successfully processed.

5. Cancellation and Termination

5.1 Cancellation by You

  • You may cancel your account at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • You will retain access to the Service until the end of your paid period

5.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach any provision of these Terms
  • You fail to pay fees when due
  • We are required to do so by law
  • We discontinue the Service

5.3 Data Export

Upon cancellation, you have 90 days to export your data. After this period, we may delete your data from our servers.

6. Proprietary Rights

6.1 Ownership of Service

The Service and all materials therein (including software, text, displays, images, and design) are owned by Backwards Thinking LLC and are protected by copyright, trademark, and other laws.

6.2 Your Data

You retain all rights to data you upload to the Service. By uploading content, you grant us a license to use, modify, perform, display, reproduce, and distribute such content solely for the purpose of providing the Service.

6.3 Feedback

Any feedback, comments, or suggestions you provide regarding the Service is entirely voluntary and we will be free to use such feedback without any obligation to you.

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in the Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8.2 Limitation of Liability

IN NO EVENT SHALL BACKWARDS THINKING LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

8.3 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

8.4 Indemnification

You agree to indemnify and hold harmless Backwards Thinking LLC from any claims, losses, damages, liabilities, including legal fees, arising out of your use of the Service or violation of these Terms.

9. General Conditions

9.1 Entire Agreement

These Terms constitute the entire agreement between you and Backwards Thinking LLC regarding the Service and supersede all prior agreements.

9.2 Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

You may not assign or transfer these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
